Live Painting Booking Terms & Conditions

At a Glance

  • A deposit reserves your event date and is applied to your package total. Your deposit is 30% of your package total, or the promotional amount shown at checkout.

  • Your date is held as soon as you receive your payment confirmation.

  • Standard deposits are non-refundable. Promotional deposits (such as expo specials) can be refunded in full if you email us within 14 days of your payment date.

  • No other payment is due until your remaining balance, which is due 14 days before your event.

1. About These Terms

These Terms are an agreement between you, the person paying the deposit (“Client,” “you”), and 4th Kind Creative LLC, doing business as Alla Prima Art Events (“the Studio,” “we,” “us”). By accepting these Terms at checkout, or by paying your deposit, you agree to them.

If someone pays on behalf of the couple (for example, a parent or planner), the person paying agrees to these Terms on the couple’s behalf and is responsible for making sure the couple has read them.

The version of these Terms in effect on your payment date applies to your booking. If we update our Terms later, the changes will not apply to your booking unless we both agree in writing. Email counts as “in writing” throughout these Terms.

2. Booking Deposit

2.1 What it does. A deposit reserves one event date for live painting services by the Studio. One deposit holds one date. Multiple events or dates each require their own deposit.

2.2 Amount. Our standard deposit is 30% of your package total. From time to time we may offer a promotional flat-rate deposit, such as an expo special. Your deposit amount is the one shown at checkout or on your deposit invoice. Either way, your deposit is applied in full toward your package total, and no other payment is due until your final balance (Section 4.2).

2.3 Standard deposits. Standard deposits are non-refundable from the time of payment, except as described in Section 3 (if your date was already booked) and Section 7 (if we cancel).

2.4 Promotional deposits: 14-day refund window. If you paid a promotional deposit, you may cancel and receive a full refund by emailing us at AllaPrimaArtEvents@gmail.com within 14 calendar days of your payment date. Your payment date is the date shown on your payment receipt or invoice. Refunds are returned to your original payment method; your bank may take 5 to 10 business days to post it.

2.5 After the window. Once the 14-day window has passed, a promotional deposit is non-refundable, except as described in Section 3 (if your date was already booked) and Section 7 (if we cancel).

3. Holding Your Date

Your date is held as soon as you receive your payment confirmation. We will follow up by email within 2 business days to begin planning your package.

In the rare event that your date was already booked before your payment went through, we will let you know as soon as possible, and refund your deposit in full, whether it was a standard or promotional deposit.

4. Packages and Payment Schedule

4.1 Your package. We will confirm your package (painting size, guest portrait hours, and any add-ons) with you in writing. Package prices in effect on your deposit date are locked in for your event.

4.2 Final balance. The remaining balance, including any travel fees, is due 14 days before your event date. If you book less than 14 days before your event, full payment is due at booking.

4.3 Late payment. If your final balance has not been received 7 days before your event, we may treat your booking as cancelled by you under Section 6.

4.4 Travel. Travel within 35 miles of our studio is included. For events farther away, we reserve the right to bill travel at $1 per mile, round trip. Any travel fee will be listed in your package confirmation. Events that require an overnight stay are quoted separately.

4.5 Taxes. Applicable sales tax, if any, will be added to your invoice.

5. Rescheduling and Event Changes

5.1 New date. If your event date changes, let us know in writing as soon as possible. If we are available on the new date, we will move your booking one time at no charge, and all payments made will transfer to the new date, provided the new date is within 12 months of the original. If we are not available on the new date, the change is treated as a cancellation under Section 6.

5.2 Venue or time changes. Please tell us promptly about any change of venue, address, or event times. A new location may change your travel fee.

6. Cancellation by You

Cancellations must be made in writing to AllaPrimaArtEvents@gmail.com. If you cancel:

Promotional deposit, within the 14-day refund window: your deposit is refunded in full.

More than 14 days before your event: a standard deposit, or a promotional deposit past its refund window, is non-refundable. Any amount you paid beyond the deposit will be refunded.

Within 14 days of your event: all payments are non-refundable. By that point we have turned away other bookings for your date and begun preparing your canvas.

7. Cancellation by Us

Alla Prima Art Events is a two-artist studio, and either of our artists may be assigned to your event. If your assigned artist cannot attend because of illness or emergency, the other artist will step in whenever possible.

If neither of our artists can attend, we will refund all payments you have made in full. That refund is the full extent of our responsibility.

We may also cancel a booking for non-payment (Section 4.3) or unsafe conditions (Section 10).

8. Circumstances Beyond Anyone's Control

If your event cannot take place because of severe weather, hurricanes, natural disaster, government order, venue closure, or similar circumstances outside either party’s control, we will work with you to move your booking to a new date within 12 months, subject to availability. If no new date works, any amount you paid beyond the deposit will be refunded, and your deposit becomes a credit toward any Alla Prima Art Events service or studio commission, valid for 12 months.

9. Event Day

9.1 Arrival and setup. We typically arrive 2 to 3 hours before your event begins to set up and start the background of the painting. Please let your venue and coordinator know we will be arriving early.

9.2 Space. We need a level area of roughly 10 ft by 10 ft with a clear view of the scene being painted, reasonable lighting, and access to a standard power outlet nearby. For outdoor events, we need shade and protection from rain, or a covered backup location.

9.3 Venue rules. You are responsible for confirming that your venue allows live painting. If your venue requires vendors to provide a certificate of insurance or has other vendor requirements, please tell us as soon as possible.

9.4 Coverage. Live wedding painting packages include painting during the ceremony and reception, as confirmed in your package.

9.5 Meals. If a meal is served to guests, we ask that a vendor meal be provided for each artist working your event.

9.6 Day-of contact. Please give us the name and phone number of a day-of contact, such as your planner or coordinator.

10. Safety, Conduct, and Equipment

We may pause or end live painting without refund if conditions become unsafe (for example, severe weather with no covered alternative, or harassment or threats toward an artist) and the issue is not resolved after we bring it to your attention.

You are responsible for damage to our equipment, canvas, or supplies caused by you or your guests. We take care to protect the venue and our work area; please help us by keeping children supervised near the painting station, as wet paint will be present.

11. Your Painting

11.1 Live and studio-finished. Your painting is begun live at your event and finished in our studio afterward. Studio finishing allows for drying time, refinement of details, and a protective final coat.

11.2 Planning. Before your event, we will go over the moment or scene you would like painted, key people to include, and your colors. We may take reference photos during your event, and with your permission we may request reference images from your photographer.

11.3 Artistic discretion. Composition, style, and level of detail are at the artist’s discretion, consistent with our portfolio. We are not responsible for moments we could not capture because of timeline changes, venue restrictions, or obstructed views.

11.4 Proof and adjustments. Before applying the final coat, we will send you a photo of your finished painting. One round of minor adjustments (such as small details of attire, hair, or décor) is included. Changes to the composition, or adding people we did not discuss before the event, may be quoted separately.

12. Live Guest Portraits

If your booking includes live guest portraits, portraits are created live during your booked hours. Every guest up to your package limit is guaranteed a portrait. Any portraits not finished live will be completed afterward from reference photos taken at your event and mailed to the address provided. Portraits for guests beyond your package limit are $20 each, and additional artist time is $200 per hour.

13. Delivery, Framing, and Ownership

13.1 Delivery. Once your painting is finished, we will arrange pickup or local delivery with you; shipping is billed at cost.

13.2 Framing. Standard canvases include one of a selection of standard canvas frames. Custom framing in any style is available through our studio.

13.3 Ownership. The physical painting becomes yours once your balance is paid in full. Until then, it remains the property of the Studio.

14. Copyright and Use of Images

14.1 Your rights. You own the physical painting. The Studio keeps the copyright. You are welcome to photograph your painting and share it on social media, and to use images of it for personal, non-commercial purposes such as thank-you cards and announcements. Selling prints or other commercial reproduction requires our written permission.

14.2 Our use. We may photograph and film the painting process, the finished painting, and our setup at your event, and use those images in our portfolio, website, social media, and marketing. If you would prefer that we not show faces or use names, tell us in writing before your event and we will honor that.

14.3 Your guests. You are responsible for letting your guests know that a live artist will be present at your event.

15. Limitation of Liability

To the extent permitted by law, the Studio’s total liability under these Terms is limited to the amount you have paid us. We are not liable for indirect or consequential damages.

16. General

These Terms, together with your written package confirmation, are the entire agreement between you and the Studio. If any part of these Terms is found unenforceable, the rest remains in effect. These Terms are governed by the laws of the State of Florida.
